Photos of artwork plaques: Processed locally on your device using ML Kit for text extraction. These photos are not uploaded to our servers or stored permanently.
Scan history and favorites: Records of artworks you've scanned and marked as favorites, stored to enhance your museum or event experience.
Museum and event activation preferences: NFC or manual activation codes used to enable museum- or event-specific features.
Language and app settings: Your preferred language and customization settings.

1.2 Automatically Collected Information

Device identifiers: Anonymous device ID used to maintain your preferences and scan history across sessions.
App usage data: Scan frequency, features used, and session duration to improve app performance.
Crash reports and diagnostic data: Technical information to identify and fix bugs.
Museum or event location context: When activated, information about which museum or event you're visiting to provide relevant content.

2. How We Use Your Information

We use the collected information for the following purposes:

Provide AI-generated artwork descriptions and artist biographies in your preferred language
Maintain your scan history and favorites for easy access to previously viewed artworks
Personalize your museum or event experience based on your interests and preferences
Improve Platform performance, features, and user interface based on usage patterns
Send service-related notifications (e.g., new features, important updates)
Analyze usage trends to understand how users interact with the Platform

3. How We Share Your Information

We do not sell your personal information. We may share data with trusted third parties for the following purposes:

Service providers: Amazon Web Services (AWS) for secure hosting and data storage in the EU region; OpenAI and Anthropic for AI-powered content generation.
Museums and event partners: Anonymized usage data and analytics about visitors who scan artworks at their venue are shared with museums and event organizers through secure dashboards, enabling them to understand visitor engagement and improve their exhibitions.
Analytics providers: Anonymized usage data for Platform improvement and performance monitoring.
Legal authorities: When required by law, court order, or governmental regulation, or to protect our rights and safety.

We do not use partner content or visitor content to train artificial intelligence models, and we contract with our AI providers on terms that exclude our data from provider model training.

4. Museum and Event Partner Data

Where a museum, institution, or event partner uses the ArtSnap CMS, ArtSnap acts as a processor in respect of personal data the partner enters, uploads, or connects for ingestion — including CMS staff account data and any personal data contained in collection records — and processes it only on the partner's documented instructions under a data processing agreement.

ArtSnap acts as controller in respect of app visitor accounts, scan history, and preferences. Partners receive aggregated and anonymized engagement analytics; they do not receive data identifying individual visitors.

Content a partner uploads, authors, or connects remains the partner's property. Ownership, licensing, export, and deletion of partner content are governed by Section 14 of our Terms of Use.

5. Data Storage and Security

Your data is stored securely using Amazon Web Services (AWS) in the EU region. We implement industry-standard security measures to protect your information:

Encryption: Data is encrypted both in transit (using TLS/SSL) and at rest.
Secure transmission: All communication between the Platform and our servers uses secure protocols.
Access controls: Strict access controls limit who can access your personal data.
Regular security audits: We conduct periodic security reviews to identify and address vulnerabilities.

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your data, we cannot guarantee absolute security.

7. Data Retention

We retain your data according to the following policies:

Active accounts: Your scan history and favorites are retained as long as your account is active.
User-initiated deletion: You can delete individual scans, favorites, or your entire account at any time through the app.
Cached artwork data: AI-generated descriptions are cached for 30 days to improve performance and reduce costs, then automatically expire.
Inactive accounts: Accounts inactive for extended periods may be archived or deleted in accordance with our data retention policies.
Partner content: Retained for the duration of the partner agreement. On termination, partners may export their content for at least 30 days, after which it is deleted from production systems within 90 days on request.

8. Children's Privacy

ArtSnap is suitable for all ages and designed to be a family-friendly educational tool. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe we have inadvertently collected information from a child under 13, please contact us immediately through the contact form on our website, and we will take prompt action to delete such information.

9. International Data Transfers

Your data is primarily stored in the EU region using AWS services. However, some third-party service providers (such as OpenAI and Anthropic) may process data in other jurisdictions. We ensure that appropriate safeguards are in place to protect your data in accordance with this Privacy Policy and applicable data protection laws.

We may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or other factors.
